Ghomeshi sucks – but we suck more…

On a scale of 80 to 200 – where anything below 80 leads one into the world of people with intellectual disabilities, and where 200 is reserved for the half-dozen or so people in the world able to reach the highest plateau of human intelligence – the average Canadian scores around 95 (having fallen from 100 a couple of decades ago).

On an intelligence scale of 80-200, the average is 95. (With 2/3rds of us under 115.)

It is important to remember this fact while watching the Jian Ghomeshi trial unfold on your nightly news, or in your local newspaper. It is important to always try to remember how relatively low functioning we are.

Because it is the only way one can understand the argument put forward by Ghomeshi’s lawyer, and implied by the media; that argument being that because the first two (of four) women who have so far been questioned in the trial tried to have further contact with Ghomeshi after he allegedly sexually assaulted them, this must therefore nullify the assault as null-and-void because if they were consenting to further contact they must therefore have consented to the previous alleged assault.

Why else would they try to contact him?

The implication being that only someone stupid and/or lying would try to contact the alleged perpetrator of their sexual assault.

Of course anyone who actually works with victims of sexual assault knows full well that there are a myriad of reasons why victims of assault return to their perpetrator – none of which undermines the act of the assault itself.

I have worked with young women (and a few young men) who have repeatedly returned to their violent boyfriend/girlfriend – despite having been hospitalized, traumatized, beaten, raped, bitten, burned, choked, chained, starved.

They return despite restraining orders, bail conditions, or the advice of sex trauma counselling.

But Ghomeshi’s lawyer is no fool. She knows just how superficial popular culture is when it comes to understanding this dirty little secret.

“If the women were stupid enough to return to the scene of the crime, then they get what they deserve.”

“If they are still attracted to Ghomeshi – if now they want to allege that he sexually assaulted them – then they must have consented and are now just scheming scanks – out for money, fame, the gold star.”

Gold-diggers, all of them!

If you listen closely, you will hear echos of that older argument, that a husband can’t rape his wife. Especially when she stays in the marriage.

What utter nonsense. Assault is assault is assault! Period!

Without consent – in-the-moment consent – no matter at what point in the moment – and all through the moment – from first whatevers to post-orgasm smokes – without consent, it is always assault.

That is all that is relevant to this case. It’s not about a bikini photo sent a year later. It’s not about the women sending follow-up emails.

It’s about consent.

If there was no consent, then it was assault.

The media seems too stupid to understand this point.

Let’s hope the judge has more than an average intelligence.
